Former President Trump Asks Supreme Court Clearance for National Guard Personnel in Illinois

On the last weekday, the White House filed an emergency request to the US supreme court, seeking clearance to send national guard forces to Illinois.

This move is part of a wider push to expand the homefront role of the military in a number of cities run by Democrats.

Court Fight Over Military Presence

In an immediate request, the US Department of Justice urged the judiciary to overturn a earlier court order that had stopped the stationing of a few hundred national guard personnel to the Chicago area.

The presiding judge had voiced concerns about the administration's reasoning for activating the guard, doubting its explanation in light of regional circumstances.

A federal appeals court upheld the lower court’s decision on Thursday, maintaining the activation on hold while the legal challenge proceeds.

Administration's Justifications

The solicitor general, speaking on behalf of the administration, claimed in the latest petition that federal agents have repeatedly been “threatened and targeted” in Chicago and the suburb of Broadview.

This location is home to an ICE holding center.

The former president has earlier deployed national guard personnel to Chicago, Illinois and the city of Portland, following prior deployments to Los Angeles, California, the city of Memphis, and the nation's capital.

The White House has argued that troop deployment is necessary to curb unrest and support border control.

Partisan Opposition

Opposition leaders have pushed back sharply the action, arguing that the White House's statements are inflated and driven by politics.

They accuse the president of abusing his power to punish opponents.

The judiciary have also voiced skepticism about the government's portrayal of the situation.

Local leaders state that protests over immigration enforcement have been largely limited and calm, challenging the administration's description of “combat area” conditions.

Legal Basis

At the heart of the dispute is the president’s use of a national law permitting the president to nationalize the state guard only in instances of insurrection or when “unable with the standard military to carry out the laws of the United States”.

The White House argues that the personnel are essential to safeguard government buildings and officers from protesters.

Recent Actions

In recent weeks, the administration took control of three hundred troops of the Illinois military reserve and ordered more Texas national guard forces into the region.

As state authorities denounced the action, the former president increased his statements, demanding the detention of Chicago’s mayor and the Illinois governor, each a Democrat, accusing them of not managing to safeguard ICE personnel.

State authorities and municipal government jointly sued the government to block the activation.

On October 9, the presiding federal judge, a Biden appointee, issued a preliminary order blocking the command.

Meanwhile in Chicago, at least a dozen people were taken into custody outside the Broadview Ice detention center following heated confrontations between state law enforcement and protesters.
